BBR partner Scott Belden successfully defended a six figure claim against a Bakersfield business brought by a former employee who alleged that he was improperly classified as “exempt.”  The employee, who claimed to hold professional licenses, was, in fact, paid a substantial salary based upon those credentials.  At the Labor Commissioner, he argued that he was actually an hourly employee who performed few if any exempt tasks that required an advanced degree.  Mr. Belden successfully proved that the employee was acting as a learned professional and was, thus, exempt from overtime pay.  A complete defense decision was reached by the Labor Commissioner.
